Cubbie Public Use - Terms of Use & Disclaimer

1. Purpose of the Cubbie Pod

Cubbie is a personal sensory regulation hub designed to provide short sensory sessions that help users manage how they feel in busy or unfamiliar environments. Each session can include adjustments to lighting, sound and visuals to create a calming or energising effect depending on individual needs.

The Cubbie is designed for temporary, individual use and is not a medical device. It does not diagnose, treat or prevent any condition.

 

2. Use of the Pod

By entering or using a Cubbie pod, you agree to the following conditions:

  1. Use responsibly. Cubbie is designed for short sensory breaks (typically 10–15 minutes). Please be considerate of others waiting to use it.

  2. One person per session. Unless otherwise indicated, Cubbie pods are intended for single-person use. Children or individuals requiring assistance may be supported by a parent, guardian, or carer.

  3. Follow all posted safety instructions inside and outside the pod.

  4. No food, drink, or sharp objects are permitted inside.

  5. Do not tamper with or modify any Cubbie equipment, software, or fixtures.

  6. Do not use the pod if you are feeling unwell, claustrophobic, or unable to exit the space without help.

  7. You are responsible for your belongings while using the pod. Cubbie accepts no responsibility for lost or stolen items.

 

3. Eligibility and Supervision

  • Children under 16 years must be accompanied or supervised by a responsible adult.

  • Users with mobility aids or wheelchairs are welcome — Cubbie pods are accessible.

  • The facility operator (e.g. shopping centre, library, etc.) reserves the right to restrict use at its discretion, for example if the pod is being cleaned, repaired, or misused.

 

4. Booking and App Use

Some public Cubbie pods may be accessed via the Cubbie App. By downloading or using the app, you agree to the Cubbie App Terms of Use and Privacy Policy available at www.cubbie.info

When creating a profile or logging in, users consent to Cubbie processing limited personal data (e.g. name, age range, session preferences) for the purpose of improving the sensory experience. Data is stored securely in accordance with GDPR and not shared with third parties except as required by law or to deliver the Cubbie service.

 

5. Health and Safety Disclaimer

  • Cubbie provides a supportive sensory environment, not a medical or therapeutic service.

  • If you experience dizziness, anxiety, nausea, or distress, please exit the pod immediately.

  • Users with photosensitive epilepsy, severe anxiety, or sensory sensitivities should consult their healthcare professional before use.

  • Cubbie and the facility operator do not guarantee that use of the pod will achieve any particular result (e.g. reduction in anxiety or stress).

 

6. User Conduct

You agree not to:

  • Damage or deface any part of the Cubbie pod or connected equipment.

  • Access or attempt to access the internal systems or software.

  • Record or take photos/videos inside the pod unless explicitly permitted.

  • Leave litter or vandalise the pod in any way.

Misuse or damage may result in removal from the premises and potential recovery of costs.

 

7. Privacy & CCTV

For safety and safeguarding, the surrounding area may be monitored by CCTV operated by the site owner. Cubbie pods do not record sound or video inside the unit.

Cubbie’s software collects only essential, anonymised session data (e.g. duration, type of sensory experience). Full details are provided in the Cubbie Privacy Policy available at www.cubbie.info

 

8. Limitation of Liability

To the fullest extent permitted by law:

  • Cubbie and the facility owner are not liable for any injury, loss, or damage arising from the use or inability to use a Cubbie pod, including (without limitation) stress, anxiety, or emotional reactions triggered by sensory content.

  • Users enter and use the Cubbie at their own risk.

  • Cubbie’s liability (if any) is limited to the cost of providing access to the service again.

This does not affect your statutory rights as a consumer.

 

9. Maintenance and Availability

Cubbie and the host venue will make all reasonable efforts to ensure the pod remains safe and operational. However, we cannot guarantee uninterrupted access or availability due to maintenance, cleaning, or technical issues.

 

10. Intellectual Property

All technology, software, and materials associated with Cubbie are the property of DMC Design Ltd t/a Cubbie and are protected by intellectual property law. Users are not permitted to copy, reproduce, or adapt any part of the Cubbie experience without prior written consent.

 

11. Governing Law

These Terms of Use and Disclaimer are governed by the laws of the Republic of Ireland and the United Kingdom, depending on the location of the pod. Any disputes will be subject to the exclusive jurisdiction of the local courts.
